FromBeyond.co provides digital legacy services including video message recording, storage, and scheduled delivery. Our services are designed to help you preserve and share memories with loved ones.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You retain all rights to the content you upload. By using our service, you grant us permission to store, process, and deliver your content according to your instructions.
You may not use our services for any unlawful purpose, to upload harmful content, or to violate any applicable laws or regulations. We strive to maintain service availability but do not guarantee uninterrupted access. We reserve the right to modify or discontinue services with reasonable notice.
You acknowledge that the accuracy and completeness of all delivery details (including recipient contact information and timing instructions) are your responsibility. FromBeyond.co relies on the information you provide and does not verify recipient details.
FromBeyond.co will use reasonable endeavours to deliver content in accordance with your instructions. However, you acknowledge that delivery may be affected by factors outside our control, including third-party services and system availability, and we do not guarantee delivery at an exact time.
To the extent permitted by law, FromBeyond.co is not liable for any failure or delay in delivery to the extent that such failure or delay is caused or contributed to by inaccurate, incomplete, or outdated information provided by you, or by events outside our reasonable control. Where a failure or delay in delivery is directly caused by our error, our liability is limited to re-performing the delivery of the content within a reasonable timeframe.
We may, but are not obligated to, attempt redelivery where delivery fails.
Once a unique access link (URL) to content has been generated and/or delivered, you are solely responsible for its distribution and confidentiality. From the point of delivery, control of the link passes to you and/or the recipient, and, to the extent permitted by law, FromBeyond.co is not responsible for any unauthorised access, sharing, or distribution of content resulting from the forwarding, interception, or misuse of such links.
As part of the service, you may have the option to trigger immediate delivery of your content to yourself for testing and verification purposes. You acknowledge that using this feature may assist in safeguarding delivery. FromBeyond.co does not require you to use this feature.
Certain subscription plans are offered with unlimited keepsake creation, subject to fair and reasonable use. FromBeyond.co reserves the right, at its sole discretion, to determine whether usage constitutes excessive, abusive, or otherwise unfair use of the platform.
Without limiting the foregoing, we may consider usage to be outside the bounds of fair use where it includes, but is not limited to: automated or bulk creation of keepsakes, use of the platform for commercial distribution or resale purposes, or any usage pattern that places disproportionate demand on our systems relative to the intended personal use of the service.
Where we determine that usage falls outside fair use, we reserve the right to limit, suspend, or terminate access to the service, with or without prior notice. We will endeavour to notify affected users and provide a reasonable opportunity to address the issue where practicable. To the extent permitted by Australian law, FromBeyond.co shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.
These terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland. We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
